This Privacy Policy sets out how we collect, hold, use and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).

By engaging our services or otherwise providing us with personal information, you acknowledge that you have read and understood this Privacy Policy.

Kinds of Personal Information We Collect

In the course of providing our services, we may collect and hold various types of personal information. The kinds of personal information we collect will depend on the nature of your engagement with us and may include your name and contact details (including postal address, email address and telephone numbers), business or practice details, professional registration information (such as AHPRA registration numbers), financial and billing information, information contained in documents provided to us for the purpose of obtaining our services, correspondence and communications with us, and any other information you provide to us in the course of our engagement.

We may also collect sensitive information where it is reasonably necessary for, or directly related to, our functions or activities. This may include health information or other sensitive information contained in documents you provide to us as part of clinical governance or compliance matters. We will only collect sensitive information with your consent, unless we are otherwise permitted or required by law to do so.

How We Collect Personal Information

We generally collect personal information directly from you or your authorised representatives. This may occur when you engage us to provide services, communicate with us by telephone, email, post or in person, complete forms or provide documents to us, visit our website, or attend meetings, training sessions or other events we conduct.

In some circumstances, we may collect personal information about you from third parties, including from your employees, contractors or agents, from other professionals involved in a matter on which we are engaged (such as lawyers, accountants or medical practitioners), from publicly available sources, or from regulatory bodies such as the Australian Health Practitioner Regulation Agency (AHPRA).

If we collect personal information about you from a third party, we will take reasonable steps to ensure that you are made aware of the matters set out in this Privacy Policy.

Purposes for Which We Collect, Hold, Use and Disclose Personal Information

We collect, hold, use and disclose personal information for purposes including providing legal, compliance and clinical governance advisory services to our clients, communicating with you and responding to your enquiries, managing our relationship with you, issuing invoices and collecting payments, complying with our legal and regulatory obligations, improving our services and developing new services, and any other purpose for which you have provided your consent.

We will not use or disclose your personal information for a purpose other than a purpose set out in this Privacy Policy, a purpose you would reasonably expect, a purpose required or permitted by law, or a purpose for which you have provided your consent.

Disclosure of Personal Information

We may disclose your personal information to our employees, contractors and agents who require access to the information in order to provide our services, professional advisers and service providers who assist us in operating our business (including IT service providers, accountants and legal advisers), government agencies and regulatory bodies where required or authorised by law, and any other third parties to whom you have consented to us disclosing your personal information.

We take reasonable steps to ensure that any third party to whom we disclose personal information is bound by privacy obligations in relation to that information.

Cross-Border Disclosure of Personal Information

We do not ordinarily disclose personal information to overseas recipients. If it becomes necessary to disclose personal information to an overseas recipient in the course of providing our services, we will comply with the requirements of the APPs regarding cross-border disclosure, including taking reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to the information.

Security of Personal Information

We take reasonable steps to protect the personal information we hold from misuse, interference and loss, as well as from unauthorised access, modification or disclosure. Our security measures include physical security measures for our premises, technological measures such as password protection, encryption and firewalls, policies and procedures to govern the handling of personal information, and confidentiality obligations imposed on our employees and contractors.

When personal information is no longer needed for any purpose for which it may be used or disclosed by us, we will take reasonable steps to destroy or de-identify the information, unless we are required by law to retain it.

You may request access to the personal information we hold about you by contacting us using the details set out below. We will respond to your request within a reasonable period. In some circumstances, we may refuse to provide you with access to your personal information, for example where providing access would pose a serious threat to the life, health or safety of any individual, or where providing access would have an unreasonable impact on the privacy of other individuals. If we refuse your request for access, we will provide you with written reasons for the refusal.

If you believe that the personal information we hold about you is inaccurate, incomplete, out-of-date, irrelevant or misleading, you may request that we correct the information by contacting us using the details set out below.
